What actually happens after UP-RERA issues a recovery certificate?
A recovery certificate is an instruction, not a transfer. UP-RERA issues it to the District Magistrate of the district, who recovers the amount from the promoter. The money then sits with the authority, not in your account, until you complete one further step of your own. Complainants regularly assume the order was the finish line and wait months on a payment that is waiting on them.
Why has my recovered money not reached my account?
In most cases because the authority does not yet hold usable bank details for you. Once the recovered amount comes in from the District Magistrate, the allottee has to file an affidavit giving the account the money should go to; the transfer is made on receipt of that affidavit. If your details were never filed, or the account has since changed or gone dormant, the funds stay parked.
What exactly goes in the affidavit?
A notarised affidavit on non-judicial stamp paper of Rs 10, stating your bank account details, or the joint account details where the allotment is joint, any amounts already received from the promoter, details of any injunction order from a competent court, and details of any bank loan together with an undertaking to repay it. Attach a copy of the passbook or a cancelled cheque as proof of the account. An account number that does not match the name on the allotment is the most common reason a file stalls.
Where do I submit it, and do I have to file it again for every instalment?
It goes by speed post or in person to the UP-RERA headquarters in Lucknow or the Greater Noida office, and a scanned copy is uploaded through the allottee login on the UP-RERA portal. You file it once, on receiving the first instalment, even where the money is recovered from the promoter in instalments.
